Please read these Terms and Conditions ("Terms") carefully before using our recruitment portal ("Portal"). These Terms govern your access to and use of the Portal provided by Parpus limited ("Company," "we," or "us"). By accessing or using the Portal, you agree to be bound by these Terms. If you do not agree with these Terms, please do not access or use the Portal.
1.1 Eligibility: The Portal is intended for individuals seeking employment opportunities and freelance work opportunities . By accessing or using the Portal, you represent and warrant that you are at least 18 years old and have the legal capacity to enter a contract.
1.2 User Accounts: To access certain features of the Portal, you may need to create a user account. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to notify us immediately of any unauthorized access or use of your account.
1.3 User Responsibilities: When using the Portal, you agree to:
a. Provide accurate and up-to-date
information in your profile and job applications.
b. Comply with all applicable laws and
regulations.
c. Treat employers and other users with respect and refrain from engaging in any form of
discrimination, harassment, or abusive behavior. (d) Use the Portal solely for its intended
purpose
and
not for any unauthorized or illegal activities.
2.1 Accuracy: You are responsible for the accuracy and completeness of the information you provide in your profile and job applications on the Portal. You understand that employers rely on the information provided and expect accurate and truthful representations.
2.2 Privacy: We will handle your personal information in accordance with our Privacy Policy, which is incorporated by reference into these Terms.
2.3 Communication: By submitting job applications through the Portal, you consent to receiving communication from employers regarding your application and the recruitment process. It is your responsibility to ensure that your contact information is up to date and that you promptly respond to employer communications.
3.1 Project Proposals: If working as a freelancer you may submit proposals for projects posted by employers on the Portal. Ensure that your proposals accurately reflect your skills, experience, and ability to complete the project.
3.2 Selection and Engagement: Employers have the sole discretion to select freelancers for their projects. If selected, you will enter into an agreement with the employer regarding project terms, including deliverables, timelines, and compensation.
3.3 Payment and Disputes: Payment terms and conditions will be determined between you and the employer. It is your responsibility to ensure that payment arrangements are clearly agreed upon before commencing work. Any payment disputes or issues arising from the engagement are solely between you and the employer. We are not liable for any payment disputes or non-performance by either party.
4.1 Professional Conduct: Maintain professionalism and integrity in your communications with employers and other users of the Portal. Be respectful, responsive, and honest in all interactions.
4.2 Timely Responses: Promptly respond to messages and inquiries from employers. Timely communication is crucial for successful project collaborations.
4.3 Confidentiality: Respect the confidentiality of any proprietary or sensitive information shared by employers during project engagements. Obtain necessary permissions before sharing or using any confidential information.
5.1 Job Offers: If an employer extends a job offer to you through the Portal, you understand that the final terms and conditions of employment will be determined by the employer and are subject to any applicable employment agreements or contracts.
5.2 Disputes: Any disputes or issues arising from your interactions with employers on the Portal are solely between you and the employer. We do not guarantee the accuracy, suitability, or legitimacy of any job opportunities or employers on the Portal.
6.1 Fee Structure: We will charge fees for usage of the portal. The applicable fees and payment terms will be communicated to you separately, and you agree to pay all fees in a timely manner.
6.2 Refunds: Fees paid for the use of the Portal are non-refundable, except as required by applicable law or as otherwise stated in our refund policy.
7.1 Portal Ownership: The Portal and its contents, including but not limited to text, graphics, logos, and software, are owned by or licensed to the Company and are protected by intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any materials from the Portal without our prior written consent.
7.2 Project/Product Ownership: If you are working as a freelancer, you retain the intellectual property rights to your work product, subject to any agreements made with the employer. The Company does not claim ownership over the work produced by freelancers using the Portal.
7.3 License Grant: As a freelancer by submitting work through the Portal, you grant the employer a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute the work solely for the purposes of the project.
8.1 No Warranty: The Portal is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Portal will be uninterrupted, error-free, or free of viruses or other harmful components.
8.2 Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Portal, even if we have been advised of the possibility of such damages.
9.1 Termination: We may terminate or suspend your access to the Portal at any time, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts in Kenya
10.2 Entire Agreement: These Terms constitute the entire agreement between you and the Company regarding the Portal and supersede any prior agreements or understandings.
10.3 Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
